RETURN AND EXCHANGE POLICY

Scope of Application

This Return and Exchange Policy is established by the company named DIGITAL NOMAD COSTA RICA, S.R.L., with legal identification number 3-102-796555; hereinafter referred to as the «Company.»

The Company owns the domain www.digitalnomad.cr and all intellectual and industrial property elements inherent to it. Additionally, the Company advertises its products and services through digital platforms, specifically on its Instagram account “Rustic House” (username: “rustichousecollab”), dedicated to selling products such as lamps, ceramics, and natural fiber items in general (https://www.instagram.com/rustichousecollab/?igshid=YmMyMTA2M2Y%3D).

It shall be understood that the aforementioned sites belong to the Company, including all its rights and associated elements (both tangible and intangible).

Objectives

The objective of this Return and Exchange Policy (hereinafter referred to as the “Policy”) is to define the guidelines and procedures to be followed by the Company regarding the specific business activity of Rustic House. This Policy aims to regulate the applicable conditions for accepting returns in limited cases, in accordance with the rules and procedures defined below.

The objectives of this Policy are established following the provisions of the Law for the Promotion of Competition and Effective Consumer Protection (Law 7472) and its regulations, as well as other regulations and policies concerning consumer guarantees.

Main Rules

– The Company provides customers with images of the pieces, including accurate descriptions of their characteristics. Therefore, the customer is responsible for verifying that the features, colors, and dimensions meet their needs before purchase. The Company will not accept returns or authorize exchanges due to the product not fitting the intended space; the customer is responsible for ensuring the items will fit in their designated areas.

– Our sales prices do not include installation or related costs. We do not provide installation advice, nor is the Company responsible for defective installations or any resulting damages. The Company solely manufactures and/or sells the products listed in our catalog. Some products may include wiring, but their proper installation is the sole responsibility of the final customer.

– Returns will not be accepted for defects or damages resulting from misuse, improper use, or any use other than what is explicitly stated in the User Manual or Product Usage Instructions.

– The Company does not authorize cash refunds or monetary reimbursements.

– The Company is not responsible for the handling of products by transport companies hired directly by the customer, unless the transportation has been guaranteed and contracted directly by the Company.

– The customer is always responsible for covering the shipping and transportation costs of purchased items, even if the shipping is coordinated by the Company.

– The Company may offer a temporary storage service for a maximum period of four months, which will incur an additional fee. The Company assumes no responsibility for damages to items during this service, nor for situations beyond its control, such as force majeure or unforeseeable circumstances.

– Notwithstanding the above, returns will be accepted only if the requirements and conditions defined in this Policy are met.

Product Condition

The Company has made it clear to customers that Rustic House products are handcrafted using natural fibers. As a result, color variations may occur, and not all pieces will be identical. Such variations are inherent to the purchased product and shall not be considered manufacturing defects. Molds or templates are not used, so there may be differences between the actual products and the photos presented, as these are also part of the artisanal process.

Applicable Returns or Exchanges

– Returns or exchanges will be accepted only for items in new condition. Otherwise, the product will not be received. A new condition means the product must be unused and in its original packaging.

No cash refunds will be issued. Any defective product eligible for replacement under the warranty period will be assessed by our experts. They will provide a diagnosis within 15 business days from the date the Company receives the information.

A return will be accepted only under the following conditions:

Duplicate orders due to internal errors.
Obvious manufacturing defects that prevent normal use, as verified by the Company.
Furniture or products with visible damages such as scratches, dents, or breakages.

Customers must inspect the condition of the items immediately upon delivery. Any issues must be reported within  48 hours of receiving the product. The Company is not responsible for damages caused by improper use, negligence, third-party handling, damages during shipping by external courier companies, or any issues beyond the warranty period.

Returns must be made in their original packaging and in perfect condition, as received.

Return Process

All return requests must be made via email to info@digitalnomad.cr, following this process:

1. Send an email to info@digitalnomad.cr specifying the reason for the return request.
2. Attachphotos of the product.
3. Attach the purchase receipt or invoice.
4. Wait for the Company’s response within the established timeframe.
5. If the claim is accepted, all shipping costs will be covered by the customer.

Once the email is received, it will be reviewed by the Company’s Management, which will determine approval. If accepted, a sales representative will coordinate the product return. Returns not approved by Management will not be accepted.

Return Deadlines

The return request must be submitted within 48 hours after receiving the product, whether received directly by the customer, an authorized third party, a designated person, or a transport company. This is subject to the conditions outlined in this Policy.

Return Management

The Company will have 15 business days from the date of notification to process the return, following this internal procedure:

1. The Company will review the request and approve or deny the return (this process is conducted digitally).
2. The Company will validate the return based on the established policies and deadlines.

Confidentiality Notice

If personal information is required to use or interact with our website, our Policy ensures that such information (including name, address, email, phone number, and other personal details) is private and confidential. This data is securely stored and accessed only by authorized personnel, strictly for the purpose for which it was provided, such as order processing and shipping.

Non-Disclosure of Information to Third Parties

The information provided to the Company will not be shared with third parties, except when required to fulfill the intended purpose or when requested by a competent authority (administrative or judicial).

Collection and Use of Information

The Company may use your information to:

– Contact you regarding your order status.
– Provide information about services and additional inquiries.
– Request feedback on your experience.

Personal data may include contact details (such as name, physical address, phone number, email, etc.), but never credit or debit card numbers. This information is used for order processing and necessary customer communication.

Applicable Legislation

This Policy and the rights and obligations of the parties shall be governed by the applicable laws of the Republic of Costa Rica. Any legal actions related to this document shall be handled in accordance with Costa Rican legislation.

Dispute Resolution

All disputes related to this Policy shall be resolved through arbitration under Costa Rican law, in accordance with the regulations of the International Center for Conciliation and Arbitration (CICA) of the Costa Rican-American Chamber of Commerce (AMCHAM).

Force Majeure

The Company shall not be held liable for any loss, damage, or delays caused by force majeure events, including but not limited to strikes, riots, natural disasters, terrorism, cyberattacks, transportation disruptions, power outages, or other circumstances beyond the Company’s reasonable control.
